Welcome to SUP Customs, LLC ("Company," "we," "our," or "us"). By accessing or using our website, purchasing our products, or engaging in our services, you agree to these Terms of Use. If you do not agree, please refrain from using our website or services.
1. General Information
SUP Customs, LLC specializes in selling LIVE Watersports paddleboards and customizing them into skiffs. We also provide hull protection with bottom coating and sell batteries, boat engines, trolling motors, propellers, and engine mounts.
2. Use of Services
You must be at least 18 years old to purchase products or services from SUP Customs, LLC. By using our services, you agree to comply with all applicable laws and regulations related to watercraft operation and safety in your area.
3. Custom Services Disclaimer
Boards ordered with custom services, including hull work, may have minor blemishes or cosmetic imperfections due to the customization process. These are normal and do not impact the board's performance.
Customized boards are recommended for single-person use to ensure optimal performance and safety.
4. Safety Protocols
Using a paddleboard as a skiff inherently involves more risks than operating a traditional boat. To ensure safety, customers must adhere to the following protocols:
- Wear a Personal Flotation Device (PFD): A U.S. Coast Guard-approved life jacket must be worn at all times while operating the skiff.
- Stay Within Capacity Limits: The skiff is designed for single-person use only. Exceeding weight or passenger limits may compromise stability.
- Monitor Water Conditions: Avoid using the skiff in rough waters, strong currents, or adverse weather conditions.
- Operate at Safe Speeds: Paddleboard skiffs are not designed for high-speed operation. Excessive speeds may result in instability or accidents.
- Stay Alert in Shallow Waters: Exercise caution to avoid grounding the skiff or damaging the engine in shallow areas.
- Ensure Proper Equipment Installation: Verify that the engine, trolling motor, and battery are securely installed and balanced before use.
- Bring Safety Gear: Carry essentials such as a whistle, waterproof flashlight, and cell phone in a waterproof case.
- Use a Kill Switch and Safety Tools: Always use a kill switch, extension handle, and any other recommended safety tools while operating a motorized paddleboard.
- Adhere to Recommended Engine Specifications: SUP Customs, LLC sells 6 hp motors but strongly recommends using no more than a 2.5 hp motor for safety reasons. Operating beyond these limits may increase the risk of accidents or injuries.
- Motorizing Risks: Motorizing a paddleboard is dangerous and may result in injury, whether used properly or improperly. Operate the motor safely at all times.
- Understand Board Stability: LIVE Watersports paddleboards are designed for stability and are hard to flip over, but they can flip in certain conditions. Avoid rough waves, and if you feel the board is at risk of flipping, bail off the board before it flips to protect yourself and your equipment.
- Air Pocket and Stability Risks: Walking to the back of the board can release the air pocket that provides stability, especially without proper bow weight, causing the board to lose balance and flip.
- Shallow Water Refueling: We recommend stepping off the board in shallow water to refill your motor or, alternatively, using an external fuel tank to avoid this risk.
- Get Familiar with the Board: We strongly recommend using the LIVE Watersports paddleboard for a while in its standard configuration before upgrading it to a full skiff. This helps you understand its performance, stability, and handling.
- Follow Local Regulations: Comply with all local boating and watercraft safety laws.
Failure to follow these protocols increases the risk of accidents, injuries, or fatalities. SUP Customs, LLC is not liable for any consequences resulting from non-compliance with safety recommendations.
5. Product Disclaimer
Paddleboards converted into skiffs are designed for specific use cases. It is the customer's responsibility to ensure proper maintenance and safe operation.
- Engine Specifications: SUP Customs, LLC sells 6 hp motors but recommends no more than a 2.5 hp motor for safety reasons.
- Motorizing Risks: Motorizing a paddleboard is dangerous and may result in injury, whether used properly or improperly.
- Equipment Use: Engine mounts, trolling motors, and batteries should be installed according to manufacturer guidelines. Improper use or installation may void warranties and pose safety risks.
- Understand Stability Risks: LIVE Watersports paddleboards are stable but can flip over in certain conditions, such as when the air pocket is released by walking to the back of the board. Customers are responsible for taking precautions to minimize risks and protect their equipment.
- SUP Customs, LLC is not liable for any accidents, damages, or injuries arising from improper use, installation, or operation of products.
6. Hull Protection Services
Our bottom coating for hull protection is intended to enhance durability in various water conditions. However, wear and tear may still occur over time. SUP Customs, LLC is not responsible for damage caused by misuse, neglect, or extreme conditions.
7. Payment and Refunds
- All payments must be made in full at the time of purchase unless otherwise agreed upon.
- Customized products, including skiffs, are non-refundable once work has commenced.
- Refunds for non-customized products will only be issued in accordance with our return policy.
8. Warranty
Warranty terms for engines, batteries, and other components are provided by their respective manufacturers. SUP Customs, LLC does not provide additional warranties beyond those offered by manufacturers.
9. Limitation of Liability
To the fullest extent permitted by law, SUP Customs, LLC is not liable for:
- Damages caused by misuse, improper installation, or failure to follow operating instructions.
- Loss of personal property, injury, or death resulting from the use of our products or services.
- Indirect, incidental, or consequential damages arising from the use of our products or services.
10. Intellectual Property
All content, including text, images, logos, and product descriptions, on the SUP Customs, LLC website is protected by copyright and other intellectual property laws. You may not reproduce, modify, or distribute any content without prior written consent.
11. Third-Party Products
Our website or services may include products from third-party manufacturers. SUP Customs, LLC is not responsible for the performance or safety of third-party products. Please refer to the manufacturer's guidelines for support.
12. Indemnification
By using our products or services, you agree to indemnify and hold harmless SUP Customs, LLC, its owners, employees, and affiliates from any claims, damages, or liabilities resulting from your use of our products or services.
